Oyelami Tajudeen was on Thursday arraigned before an Osogbo Magistrates Court for alleged theft of N1.2 million chickens.

The prosecutor, Insp. Adegoke Taiwo told the court that the accused person committed the offence sometimes between May and July at Erin Osun area, Osogbo.

Taiwo said the 46-year-old accused had refused to pay for the chickens sold to him on credit by one Mrs Dorcas Ajibola.

He said it took the intervention of the Police to apprehend the accused.
Taiwo said the offence committed contravened sections 427 of the criminal code cap. 34 vol.11 Laws of Osun, 2003.

The accused person pleaded not guilty to the one count charge of theft.
Counsel to the accused, Mr Maruf Adediran, prayed the court to grant his client bail in the most liberal terms.

The Magistrate, Mrs Fatimoh Sodamade granted the accused bail in the sum of N200,000 and two sureties in like sum.

Sodamade said the sureties must reside within the court’s jurisdiction, provide evidence of tax payment and two passport size photographs attached with an affidavit of means.
The case was adjourned to Sept. 13 for mention.

  1. The chicken were SOLD so it is a matter of indebtedness-” Gbese” NOT ” theft. Although this man is a hard headed debtor, it is no crime to owe. Indeed, even Nigeria OWES debt….. Unpaid salaries to workers, unpaid emoluments etc and nobody has prosecuted the country.
    The man should have been sued in a civil action for recovery of the amount owed..
    I am by no means siding the man. It is selfish and wicked to owe without making any effort to pay back even by instalments. So he is a bad man but not a criminal. ONI Gbese!!!

  2. this man is a debtor,not a criminal,even mrs fatimoh sodamade dat is doing baba God work by judging him is also a debtor bcus she is owing some people in one way or the other.and u @fifelomo dat is asking why wont he pay his debt,cant u see dat nigeria economy and sitaution is nothing to write home about? or do u need father mbaka to prophesie again for u to understand.make una leave dat man ojeri,when things normal he go pay his debt.

  3. If he had the INTENT not to pay for the chickens at the time he purchased them, then it is theft. If he changed his mind not to pay for them AFTER he got possession (delivery), then it is a debt. I wonder if it is possible for the chickens to be re-possessed and returned to the supplier, or have they ended up in someone’s pepper soup joint?

  4. People are owing me enormous debt. But each time I pondered over what to do with them,I feel powerless because they are debtors. I gave them those money,they didn’t still it from me. Though I threatened a lot but without action and some of them have started responding. But I feel sometimes court are not getting things right here. How can you charge a debtor with one count of theft in the court? I strongly disagree with this charge. This is a complete perversion of justice! That man is not a thief but a debtor. And I know the man did not refuse to pay his debt, those are just lies in order to charge him to court. What I expected the chief judge to come out with is to determine the amount the debtor will be paying every month probably #50,000 so that the man will also have the means to manage up with his wife and children too. Ok,what if out of pressure the man decided to commit suicide,who do they think is going to pay that money? Especially when no document is signed that would involve the next of kin. They are so lucky they are dealing with a man that has already accepted the verdict and who can’t probably afford to appeal the case.
