The question we need to ask is did she(Funke) register the name as a trademark? If not, no one can blame the people that have used the name for their own gain. Otherwise she can go ahead and sue them if indeed the name was used without her consent.

The question we need to ask is did she register the name Jenifa as a trademark? If not then we cannot blame the smart business person that has used the name for thier own gain. However, if she has then she has the legal right right to sue them if she was not aware that the name will be used for business.
