In a country where law against homosexuality is in full force, 2 Nigerian men have been docked before a Lagos Magistrate Court sitting in Yaba for allegedly having unlawful carnal knowledge of another man.
Based on the charge preferred against Chinenye, 30 and Michael, 23, both conspired and slept with the alleged victim (name withheld) who they had earlier met on the Facebook. naijagists.com
The two defendants were alleged to have stripped the complainant Unclad and fondled his joystick before inserting their manhood in his anus. According to the prosecution, apart from sexually abusing the victim, they also alleged to have demanded money from him in return for his Unclad photographs taken during the indecent act.
The incident happened at 11, Appollo Street, Makoko, Yaba residence of the defendants where the complainant had visited them before the alleged offence was committed. The men, however, denied that they forcefully stripped him Unclad. They claimed that he stripped himself Unclad.
The victim, allegedly parted with his handsets and ATM card as a condition for his release and promised to bring the money requested by the defendants. On the agreed day, the complainant lodged a report at the Adekunle Station and policemen followed him to the house where they arrested the defendants.
They were arraigned on a 12-count charge of criminal conspiracy, assault and unnatural offence under sections 352, 516 and 353 of the Criminal Code, Cap.17, Vol. 2, Laws of Lagos State of Nigeria, 2003. They pleaded not guilt to the charges and the presiding magistrate, Mrs. S. K. Matepo, granted them bail in the sum of N200,000 with two sureties in like sum.
The matter was later struck out because the complainant refused to show up in court.
